You do not need a realtor to buy new construction in El Paso, but you probably want one, and it almost never costs you anything. The person sitting in the model home is the builder's sales representative. They are paid by the builder, they represent the builder, and their job is to get the best outcome for the builder.

That is not an accusation. It is a job description, and most of them are perfectly pleasant people who are good at their jobs. The problem is that buyers walk into a model home on a Saturday assuming that person is helping them the way an agent would, and then sign a contract written entirely by the builder's attorneys.

## Who the Builder's Representative Works For

In Texas, a builder's on site sales agent is either an employee of the builder or an agent whose brokerage represents the builder. Either way, their fiduciary duty runs to the builder.

Practically, that means they will not tell you:

- Which lots in the section have drainage or retaining wall issues
- What the builder has accepted off list price in the last sixty days
- Which upgrades hold value at resale and which do not
- That the incentive requires their in house lender at an above market rate
- What comparable resale homes two miles away are selling for

None of that is dishonest. They simply are not your advocate and they are not obligated to volunteer information against their employer's interest.

## The Registration Rule That Costs People Money

This is the single most important thing in this article.

Almost every builder in El Paso has a registration policy. Your agent must accompany you or register you on your **first visit** to the community. Not the second visit. Not when you decide to write a contract. The first time you walk through the door and sign that clipboard.

If you tour alone in September and bring an agent in October, most builders will refuse to recognize your agent. At that point you have two choices: proceed unrepresented, or hire an agent and pay them yourself.

So if there is any chance you might want representation, bring your agent the first time or at minimum call them before you go. A two minute phone call preserves the option. Losing it is permanent.

## Does It Cost You More?

No, and this is the part buyers get backward.

Builders budget agent compensation into their sales costs the same way they budget for the model home and the sales office. When a buyer arrives unrepresented, the builder does not hand the buyer that money. The builder keeps it.

You are not saving anything by going alone. You are just removing the only person in the room who works for you.

The one exception worth knowing: a few builders in tight markets have experimented with reducing incentives for represented buyers. That is rare here. Ask directly, in writing, and compare.

## What an Agent Actually Does on a New Build

If the price is set and the contract is the builder's form, what is left to do? More than you would think.

**Read the contract and the addenda.** Builder contracts are not the Texas Real Estate Commission promulgated forms most El Paso buyers see. They are written by the builder's counsel, they favor the builder, and they run long. Arbitration clauses, completion date language, and what happens if you cannot close on time are all in there.

**Negotiate what is actually negotiable.** Base price is usually firm. Upgrades, closing cost contributions, appliance packages, lot premiums, fence and landscaping allowances, and the rate buydown are not. Builders often protect list price and give ground on everything else, because list price sets the comparable sales for the rest of the section.

**Push back on the lender incentive.** Most builders offer a significant incentive tied to using their affiliated lender. Sometimes that is a genuinely good deal. Sometimes the rate is a half point above market and the incentive is smaller than what the rate costs you over five years. Run both. You are allowed to use the builder's lender and still have your agent check the math.

**Order an independent inspection.** New does not mean flawless. I have seen missing attic insulation, backwards ductwork, and drainage graded toward the slab, all in brand new houses. **Manage the walkthrough and punch list.** The final walkthrough on a new build is a detailed exercise, not a formality. Items not written down before closing become warranty requests, and warranty requests move slowly.

**Watch the timeline against your loan lock.** Build delays are common. If your rate lock expires before the home is finished, that is your problem, not the builder's, unless someone negotiated an extension provision.

Most new construction here is on the far east side, in Eastlake, Horizon, and the growing sections beyond, with additional activity in the northwest. Lots are generally smaller than older parts of town, the homes are more energy efficient, and property taxes can include a municipal utility district or public improvement district assessment that older neighborhoods do not carry. That last item can add meaningfully to your monthly payment, so ask for the total tax rate on the specific lot rather than the neighborhood average.
